CHAMBER OF TRADESMEN AND CRAFTSMEN
COURSES AND EXAMS TO BE HELD BY
DIRECTIVE ON PRINCIPLES AND PROCEDURES

FIRST PART

General provisions


Aim
ARTICLE 1- (1) The purpose of this Directive is, in accordance with the Regulation on the Issuance of Professional Certificates in Vocational Branches Where Apprenticeship Training is Not Provided, dated 14 January 2008 and numbered 26756, issued based on Article 75 of Law No. 5362, in professions that are not within the scope of apprenticeship training application of the Vocational Training Law No. 3308, To determine the principles and procedures of training courses and examinations to be held by professional organizations of tradesmen and craftsmen in order to issue TESK professional certificates.
Scope

ARTICLE 2- (1) This Directive covers professional organizations of tradesmen and craftsmen that organize training courses and exams to issue TESK Journeyman Certificate, TESK Mastery Certificate and TESK Tradesman Certificate within the framework of the provisions of the relevant regulation issued based on Law No. 5362.

Rest

ARTICLE 3- (1) This Directive has been prepared based on the Regulation on the Issuance of Professional Certificates in Vocational Branches Where Apprenticeship Training is Not Applied, dated 14 January 2008 and numbered 26756, which was issued based on paragraph (j) of Article 75 of Law No. 5362.

Definitions

ARTICLE 4- (1) In this Directive;

a) Ministry: Ministry of National Education,

b) Union: Unions of chambers of tradesmen and craftsmen established in accordance with Law No. 5362,

c) Federation: Federations of tradesmen and craftsmen established in accordance with Law No. 5362,

ç) Confederation: Confederation of Turkish Tradesmen and Craftsmen,

d) Including the profession branch: Professional branches that have been decided to provide apprenticeship training in accordance with the Vocational Education Law No. 3308,

e) Professional documents: TESK Journeyman, TESK Master and TESK Tradesman Certificates issued in accordance with the provisions of the Regulation on the Issuance of Professional Certificates in Vocational Branches Where Apprenticeship Training is Not Provided, dated January 14, 2008 and numbered 26756,

f) Chamber: Chambers of tradesmen and craftsmen established in accordance with Law No. 5362,

g) TESK mastery certificate: documents issued by the chambers of tradesmen and craftsmen to those who own a workplace subject to Law No. 5362 and/or to those who actually work as masters in this workplace, in accordance with the Regulation on the Issuance of Professional Certificates in Professions in which Apprenticeship Training is Not Applied, dated January 14, 2008 and numbered 26756,

g) TESK journeyman certificate: Documents issued by the chambers of tradesmen and craftsmen to qualified employees who do not own a business, in accordance with the Regulation on the Issuance of Professional Certificates in Professions in which Apprenticeship Training is Not Applied, dated January 14, 2008 and numbered 26756,

h) TESK tradesman certificate: The document issued by the chambers of tradesmen and craftsmen in professions that do not require mastery skills, in accordance with the provisions of the Regulation on the Issuance of Professional Certificates in Professions in which Apprenticeship Training is Not Applied, dated 14 January 2008 and numbered 26756,

i)Regulation: Regulation on the Issuance of Professional Certificates in Vocational Branches Where Apprenticeship Training is Not Implemented, dated 14 January 2008 and numbered 26756

SECOND PART

TRAINING COURSES AND TRAINING PROGRAMS

training courses
ARTICLE 5- (1) Chambers may organize training courses, within their means, for the members of the chamber who will take the exam to obtain journeyman, master and tradesman certificates, and their employees, in order to prepare for the exam.

Management of courses

ARTICLE 6- (1) Courses are carried out under the management of the chamber president or the chamber official appointed in his place. The chamber board of directors is directly responsible for the opening, operation and completion of the courses.

Duties and responsibilities of the course administrator
ARTICLE 7- (1) The chamber training director or a suitable officer is appointed as the course supervisor, with the approval of the chamber board of directors.

(2)Course responsible;

a) Monitoring the attendance of trainees and trainers in classes, issuing attendance slips and reporting absences to the course management,

b) To provide and maintain educational tools and equipment,

c) To ensure that the training is carried out and completed in an orderly and disciplined manner.

Assignment of trainers, their responsibilities and course fees

ARTICLE 8- (1) In terms of the courses included in the curriculum programs of the courses, the trainers who will teach the course are provided by the chambers in cooperation with local administrations, Ministry institutions and universities.

(2) Trainers who will teach the courses;

a) To prepare according to the course curriculum,

b) Completing the program by applying modern education methods during the course subjects and using tools, equipment and materials appropriate to the course subject.

They are obliged.

(3) Lesson fees to be paid to trainers working in courses are determined by the chamber board of directors and paid from the chamber training budget at the end of the course.

CURRICULUM PROGRAMS OF COURSES
ARTICLE 9- (1) In courses, Baka

These programs will be applied in the professions for which curriculum programs have been prepared by the Ministry.

(2) In professions for which a curriculum has not been prepared; Curriculum programs are prepared and implemented in courses by the vocational education consultancy units of the relevant federation in professions that have a federation, and by the vocational education consultancy units of the unions in professions that do not have a federation, with the support of field experts when necessary. Framework curriculum programs prepared by federations and unions are put into practice after the approval of the Confederation.

 

THIRD PART

Exams and Exam Commissions

 

Exam times

ARTICLE 10- (1) Professional certificate exams are held by the relevant chamber at least twice a year.

(2) Exams are planned and announced by the union to which the relevant chamber is affiliated, upon application.

Form of exams

ARTICLE 11- (1) Exams are conducted by examination commissions in two stages: written and practical. Those who pass the written and practical exams are entitled to receive a professional certificate.

(2) TESK Tradesman Certificate exams are conducted only in written form.

Formation of examination commissions

ARTICLE 12- (1) The examination commission is chaired by the chamber president or the chamber board member he appoints;

a) 2 members from the relevant profession to be appointed by the chamber presidency,

b) 1 member from the chamber vocational education consultancy unit,

c) 1 member to be appointed by the directorate of national education from among the teachers of apprenticeship training centers or, if there is no apprenticeship training center, from among the teachers in other vocational and technical education institutions.

It consists of five people in total.

(2) It is essential that the examination commission member appointed by the directorates of national education be selected from among those who teach in one of the branches within the profession in which the examination will be held. However, in the educational institutions within the borders of the district where the exam is held, teachers in the closest branches can be assigned to professions where there are no teachers in the branch. Teachers in this situation contribute to the exams not in terms of professional content, but in terms of question preparation methods and techniques and the procedures and principles of the exam.

(3) Calls to duty for members of the examination commission are made in writing. The exam can be held if at least three commission members are present, one of whom is a member appointed by the Ministry.

Duties of examination commissions

ARTICLE 13- (1) Exam commissions; It is responsible for preparing the exam questions, conducting the exams regularly and duly, evaluating the results, recording them in the relevant forms and notebooks, and submitting them to the chamber management.

Travel and attendance allowances to be given to members of the examination commission

ARTICLE 14- (1) The chairman and members of examination commissions are paid regardless of whether they work in public or private institutions.

(2) The fees to be paid to the members of the examination commission are determined by the board of directors of the relevant professional organization of tradesmen and craftsmen and paid from the education budget, provided that they remain within the limits stipulated in Article 56 of Law No. 5362.

Written exams and evaluation

ARTICLE 15- (1) Written exams are held by the examination commission in test and/or classical method at the place and time determined in advance and announced by the Union. Written exam duration is 60 minutes.

(2) Written exams are evaluated according to the answer key, based on 100 total points. The points given for the courses are added up and written in the section at the top of the answer sheet.

(3) At the end of the evaluation, those who score 70 or more in total are considered successful.

(4) Evaluation procedures are carried out by examination commissions.

Practical exams and evaluation

ARTICLE 16- (1) Those who are successful in the written exams are subjected to a practical exam at the place and time determined by the exam commission (within 3 days after the written exam). Those who score 70 out of 100 total points in the practical exam are considered successful.

(2) In the practical exam, the person is asked about practical knowledge and skills related to the profession he/she is engaged in, and if necessary, they are applied.

(3) The results of the practical exam are evaluated immediately by the commission and determined in a report, signed by the commission members and notified to the person taking the exam.

Announcement of results

ARTICLE 17- (1) The scores and results obtained from written and practical exams are recorded in the relevant lists and forms and signed by the members of the examination commission.

(2) Exam results are announced within 15 days at the latest by writing them on the lists and hanging them in the room. If the Chamber deems necessary, it may also notify the relevant parties of the exam results in writing.

(3) Original copies of the exam result lists are kept in a special file.

Objection to exam results

ARTICLE 18- (1) Written exam results may be objected to, provided that it is based on a justified reason. The objection is made within 3 business days following the announcement of the exam results.

(2) Objections are examined by the commission conducting the examination within 3 days, any errors are corrected and stopped.

This is determined in a report and the result is notified to the objector.

(3) Applied exam results cannot be objected to.

Situation of those who failed the exams

ARTICLE 19- (1) Those who fail the written and practical exams by getting less than 70 points can take the exam again in the next semester.

(2) Those in this situation will not be asked for the previously requested documents, but the exam fee will be charged again.

(3) Those who fail the written and practical exams are given the right to take 5 more exams starting from the following exam period. However, those who are not successful in 5 consecutive exams will not be given a certificate and will not be registered in the chamber or registry.

(4) Those who have a legal excuse during the written and practical exam period are deemed not to have used their exam rights if they document their excuses.

Storage of written and practical exam documents

ARTICLE 20- (1) All documents related to written and practical exams are kept by the chamber for 5 years and are destroyed according to a report at the end of this period.

 

CHAPTER FOUR

Issuing and Issuing Documents

 

Issuing and issuing documents

ARTICLE 21- (1) Those who are successful in the written and practical exams are given TESK Journeyman Certificate, TESK Mastery Certificate or TESK Tradesman Certificate appropriate to their status.

(2) While the document is being prepared;

a) All information in the document is written completely, legibly, without erasure or scraping, and is photographed. In the document, the clear identities of the authorized officials are written and signed.

b) Documents that need to be canceled for any reason during issuance are canceled and destroyed after they are identified in a report stating their serial numbers.

c) The issued documents are recorded in the Book of Those Eligible to Receive Documents and given to the right holder in return for signature.

Documents to be requested from those who will take the exams

ARTICLE 22- (1) Among those who will take the exams;

a) Application form (if available) or petition,

b) Journeyman Certificate (only for those who will take the mastery exam),

c) Copy of primary school diploma (notary or chamber will certify),

d) Residence certificate,

e) 3 photographs,

f) exam fee receipt,

is desired.

(2) Those who submit the above documents and documents to the room in full can take the exams.

Replacing lost and worn documents

ARTICLE 23- (1) Documents that are lost or worn out and become unusable, if the owner applies to the chamber where he received the document with a petition, a new document is issued and given against a fee.

(2) Information regarding the renewal of the document is recorded in the registry and a note is made in the first issue section of the document, stating the reason for renewal.

 

CHAPTER FIVE

Miscellaneous Provisions

 

Exam income and expenses

ARTICLE 24- (1) Course and exam expenses are covered from the training budget of the chambers. The income obtained from the courses and the examination fees collected from the examinees are also included in the chamber's education budget.

(2) Expenses for all documents, forms, lists and notebooks used in the implementation in accordance with the provisions of the Regulation are covered from the chamber training budget. Likewise, the revenues obtained from the sale of these documents, forms and lists are also included in the chamber training budget.

Exam fee

ARTICLE 25- (1) The Chamber collects examination fees from those who apply to take the examination to obtain a professional certificate. The examination fee is determined by the Confederation every year and announced to the sub-organizational units.

Planning and coordination

ARTICLE 26- (1) Planning, coordination and supervision of the practices to be carried out in accordance with the provisions of the Regulation are carried out by the Confederation together with the relevant federations at the country level, and by the unions at the provincial level.

Printing and distribution of documents, forms, lists and notebooks to be used

ARTICLE 27- (1) All documents, forms, lists and books to be used in the implementation in accordance with the provisions of the Regulation are printed by the Confederation and distributed by the unions in return for a fee.

(2) Fees for all documents, forms, lists and books used in practice are determined by the Confederation and announced to the sub-organization.

Authorization to sign documents without examination

ARTICLE 28- (1) TESK Journeyman Certificate, TESK Mastery Certificate and TESK Tradesman Certificate, which are given without examination, are signed by the chairman of the chamber board of directors and 2 members to be determined by the chamber board of directors.

Application to be made after the profession is included in the scope

ARTICLE 29 – (1) Starting from the date when the decision to include a profession that is not within the scope of Law No. 3308 is announced in the Official Gazette, all transactions in this profession are carried out in accordance with the provisions of Law No. 3308.

Commission for the separation of tradesmen and craftsmen professions

ARTICLE 30- (1) A commission to separate craftsmanship and craftsmanship professions is established within the Confederation in order to determine professions that require mastery skills and professions that do not. Commission; One member representing the Ministry of Industry and Trade, one member representing the Ministry of National Education, under the chairmanship of the Chairman of the Confederation or the member of the TESK Board of Directors to be appointed by him/her.

It consists of a total of five members: one member and two members representing the Confederation.

(2) The Commission determines and decides on the professions that are out of scope to be included in the application of the Regulation, and this decision and the work to be carried out after the decision are announced to the sub-organizational units of the Confederation.

ARTICLE 31- (1) Issues not regulated in this Directive are determined by the Confederation within the framework of laws and regulations.

Force

ARTICLE 32- (1) This Directive shall enter into force on the date it is announced by circular.

Executive

ARTICLE 33- (1) The provisions of this Directive are implemented by the President of the Confederation.
